Default what should I do?

Ok I still do not have my pro. pictures. I'm getting really mad about this! I'm at the point if she lived closer I would be at her door knocking. My contract says 4 weeks well it was 6 weeks yesterday. This is the last email I got from her on the 8th.

Dear Lesley

Sorry I am hard to reach. I have been sooo busy that I can't get all of my phone calls returned. I was out of town for several days as well. You pictures will be ready by the 20th and you should recieve your album towards the end of that week. I am so greatful for the gifts that I have been given. I just wish I could find more hours in a day so that I could keep up with demand. I hope the two of you are doing well and enjoying "the married life".

I didn't fuss with her because I want my pictures and I want her to do a good job on them. I'm at the point where I'm calling my layer but I keep stopping my self cause I really want my pictures and I want them to be right. I emailed her last night and I called her today of course she don't answer. What would you do?

Yep. Have you paid in full yet? If not, since she's not holding up her end of the contract, I'd demand a discount.

It's the week of the 20th... I hope you get your pics by Friday!

take a deep breathe! i know u have to be going crazy over this. i would as well. i think if you dont receive your photo by the end of this week then seek legal actions.

My layer looked at it b-4 I signed it and she said every thing was fine with it. I called my layer two weeks ago and told her about the email and she said if I wanted to wait the 2 weeks to do so but she could give her a call. But I'm trying not to do that cause I'm scared she will %^*& the pictures up.

I had to pay in full by the wedding day and it was crazy. I don't suggest any one get a out of town photographer. I mailed her the final check like on the 3 of April and on the 20th she called to see why I hadn't mailed it. Her next door neighbor had got the check well I put a stop payment on the check and the next day he cashed it so the bank is taking care of that part. Any ways I UPS over night her a new check and every thing was paid by the 25 of April. The way I read the email is that the pictures would be ready to view on her web site by the 20th and I would get my book and every thing by the end of the week.

Have you found a job yet? Perhaps send her back the email and explain that it's 2 weeks over due. You selected her for her "gift", but that if she is having issues with demand, perhaps she could use someone with a "gift" at schedualing and managing her scheduale... and that you know the perfect canidate!

lol thats a good thought but she lives over 2 hours away. I think I have a job just waiting on the call to let me know when to come observe. It will be a long process but once I'm there 6 months to a year I can go any where and get a job.

Gee, I'm sorry the photographer is being so slow. It took me almost 2 months to get mine. But, she told me it would from the beginning. It sucks that she's now given you two different dates and defaulted on both of them.

I do plan on calling them just don't know if I should do it now or wait till I get my pictures.

By the looks of it, thats assuming you GET the pictures... it doesnt take long to upload pictures online... too bad she doesnt realize that doing that would at least give you something so if she needed more time to get the album together you MIGHt be more willing.

I would be getting pretty hostile by now in my messages though... but thats me. Keep all your documentation though for sure... in case you have to sue her later. Peoples court.... wheres the proof!

I have every email and letter she has ever sent me and I have a copy of every thing I sent her and I used my calling card every time since the 1st of this month to call her so it would be on record. My home phone long distance is one price so it don't show when I would call her.

I say to hell with waiting, you've given her plenty of time....to court I would go....but I'm in a mood right now so maybe I wouldn't feel like that later, but it sounds good....sorry I'm no help. Give her til the end of the week. No pic's, then call her on Monday, leave a message that you've been very patient and you can't wait any longer, you've been promised pic's and have yet to recieve them and you will be contacting a lawyer to review your rights as a consumer. Blah blah blah.....I'm done rambling. Good luck!!!!

What about asking Sharon??? I'm sure she has a graciouse way of motivating a vendor to fullfil their contracted time line.

If it were me, I would give it until Monday the 26th. I know that may seem hard right now, but if this woman is that busy, you certainly don't want her to rush anything and risk not getting all of your photos or getting shitty photos.

If you still haven't received anything online or in the mail, send her a certified letter with a copy of the original contract and a copy of all of the e-mail exchanges. As someone mentioned above, high-light areas where she gave you a date that has passed. Give her 5 business days from the time of receipt to get you your things. If she doesn't hand everything over by then, file a small claim. She'll be notified in probably 2 or 3 business days and that will get her attention for sure.

I agree with Heather. The certified letter may give her the little push she needs and let her know that you mean business. Plus, it will give you proof that you notified her that she has failed to satisfy the conditions of your contract. If she doesn't respond to your satisfaction (giving you the pics), I would file a claim in small claims court.

At any rate, I would ask her for a partial refund of my money (once I had the pics) due to the delay.

I guess my phone call worked cause for the past hour I've been jumping around like a little kid in a candy store. I would post them but she has a copy thing on there so I won't be able to post my fav till I get my CD with copyrights.

Sorry I missed this whole thing! Not that I had any really good advice. But I agree with everything everyone said. So for future reference for other brides who might be in this predicament, go for the small claims court. Vendors should absolutely follow through with the original agreement designated in the contract. And if they don't - they should not be paid (at least in full)

But all is well now for you LJ! I'm so glad you got your pics and I can't wait to see them!

Give her a quick chance to take care of it, otherwise demand a discount or take her to small claims. Chances are, she's not trying to stiff you she's just a bit of a scatter brain. Good luck!
